A DIGI SOLUÇÕES DE COMUNICAÇÃO LTDAhereinafter referred to as "Smartspace", a legal entity governed by private law, registered with the CNPJ under No. 06.126.611/0001-67, with its head office in João Pessoa, Paraíba, Brazil, with a view to the right to privacy of Users and in observance of the precepts and definitions established by the General Personal Data Protection Law (LGPD), establishes this Privacy Policy in order to transparently describe how personal data is collected, processed and stored in the Marketplace.
Smartspace's Marketplace is an omnichannel communication platform that offers the best customer service experience, creates a real-time collaborative environment for your workforce, monitors processes and manages telephony costs. It implements fluid communication through multiple channels integrated into a single platform.
DEFINITIONS
Cloud storage: designates the technology used to store data by means of an online service.
Legal bases: term used to refer to the legal hypotheses that authorize the processing of personal data (articles 7 and 11 of Law 13.709/2018).
Controller: Any natural or legal person who is responsible for decisions on data processing.
Data ControllerPerson appointed by the controller and operator to act as a communication channel between the controller, the data subjects and the National Data Protection Authority (ANPD);
Personal Data: All information that identifies or makes identifiable a natural person.
Purpose: Personal data will be processed in accordance with the specific purposes set out in this privacy policy.
Necessity: Smartspace will only process personal data that is necessary to achieve the purposes set out in this privacy policy.
Privacy Policy: document that explains to users what personal data will be collected when they access Smartspace's systems.
User(s): term used to designate the people who access Smartspace's solutions.
Licensor: The person who licenses the software, in this case SmartSpace
Licensee: The person who owns the license, i.e. the natural or legal person who has signed the contract with the licensor.
WHAT INFORMATION DO WE COLLECT, HOW DO WE COLLECT IT AND FOR WHAT PURPOSE?
Smartspace develops and supplies solutions that integrate communication channels, manage and provide access to reports in real time, optimize processes, reduce operating costs with communication, and increase customer satisfaction.
Smartspace collects User data through interactions with the software that is strictly necessary to fulfill the purposes described in this Privacy Policy, specifically in topic 3, including to operate efficiently and provide the best experiences with our products.
Some of this data is provided directly, for example, when you create a Marketplace account, manage your organization's licensing account, submit a search query, pronounce a voice command, upload a document or contact us for support. Smartspace obtains the data as follows:
Registration on the Platform: full name, gender, nationality, CPF, e-mail address provided by the user;
Device data: hardware model and operating system;
Access loglogin, date and time;
IP addressobtained by the access device, after authorization by the user;
Cookies and beacons when browsing the software: technical information (computer or mobile devices): information about the computer or other mobile device used to access the website or app, such as the IP used to connect to the internet and geographical location.
Users may disable or delete cookies as they wish. Once enabled, cookies will be issued by Smartspace as long as there is interaction with the platform.
It is up to the USER to configure their device if they wish to block the collection of cookies or other data. In this case, some functionalities of the solutions may be limited;
Use of certain functions: photo and image, via the device's camera or gallery, and via the microphone.

DATA PROCESSING AND LEGAL BASES
The processing of the User's personal data by Smartspace includes the collection, production, reception, classification, use, access, reproduction, transmission, distribution, processing, archiving, storage, deletion, evaluation or control of the information, modification, communication, transfer, dissemination or extraction of the data. This processing is based on the following legal bases:
Execution of Services: execution of contracts and preliminary contractual procedures;
Compliance with obligations: legal or regulatory by Smartspace;
Regular exercise of rights: in judicial, administrative or arbitration proceedings;
Legitimate interests: support and promotion of Smartspace activities, to perform user behavior analysis and to create strategies for product improvements and evolution.
Consent: In cases where it is necessary, in accordance with current legislation.
In cases where your consent is the legal basis for processing Personal Data, you will have the right to deny it or request its revocation at any time through the channels described in section 10 of this Policy.
INTELLECTUAL PROPERTY
The software are protected by copyright and are the legitimate property of SmartspaceLaws 9.609/98 and 9.610/98 apply to this contract. Any reproduction or representation of these elements, in any form and for any any reason, without our prior authorization, under the terms of the LPI.
DATA STORAGE AND DELETION TIME
Smartspace will store User data for the duration of the relationship between the licensor and licensee, in a local browser. However, there is the possibility of storing the data collected for longer than is necessary to fulfill the initial purpose, when permitted by Applicable Law or so that Smartspace can defend its interests in administrative, judicial, extrajudicial or arbitration proceedings.
In accordance with current data protection legislation, Smartspace and the licensee adopt security procedures to protect the privacy and integrity of their Users' personal data. However, this does not guarantee that incidents will not occur.
Users undertake to alert and notify Smartspace if they identify any misuse of their personal data. In the event of an incident involving Users' personal data, Smartspace will take the necessary measures to mitigate any damage and will notify everyone.
Data collected in accordance with topic 2 will be deleted from Smartspace's databases at the request of the data subject or upon termination of the license between the licensor and the licensee, in accordance with Article 16 of the General Data Protection Act. However, if there is a reason that authorizes or requires the storage of personal data for a longer period of time, Smartspace reserves the right to keep the data as long as it is legally supported.
Smartspace informs you that, depending on the terms and conditions of the contract between the licensor and the licensee, there may be backup copies of the database by the licensor or the licensee.
USERS' RIGHTS
The User may request the enforcement of rights via the following e-mail address:
- Access to the data they hold;
- The correction of outdated, inaccurate or incomplete data;
- Information on the sharing of your personal data with third parties;
- The deletion of your personal data;
- Portability to another service or product provider
IN WHICH CASES CAN YOUR DATA BE SHARED?
In the event that General Data Protection Law (LGPD) compliance bodies contact Smartspace with a request that results in the possible sharing of data, Smartspace will seek to redirect these bodies to request it directly from the User.
However, if Smartspace is obliged to disclose personal data to these entities, in strict compliance with a legal duty, the User will be notified immediately, as well as receiving a copy of the data passed on by the licensor, unless this practice is prohibited by law.
Smartspace informs that there is the possibility of processing or storing the data collected in companies outside Brazil, in any country where it does business, has facilities or contracts service providers.
By using the Services, the User is aware that their Personal Data may be transferred to countries outside their country of residence, which may have data protection rules that differ from those in Brazil.
To ensure adequate protection and security in these international transfers of personal data, we take measures such as collecting your consent and adopting contractual terms with our business partners that include the best international standards for personal data protection.
HOW DOES INFORMATION SECURITY WORK AT SMARTSPACE?
Smartspace makes every effort to protect the privacy of the User's account and personal data, but this does not mean that incidents or security breaches cannot occur.
Through the login and password created, the privacy and security of their account is protected, and the User must prevent and avoid unauthorized third parties from accessing their account. It is the User's responsibility to adequately protect the password and/or connection mechanisms and limit access to their device or browser, logging out after access to the account has been completed.
Smartspace adopts the best information security and secure development practices on the market, as well as password encryption, anti-malware, anti-phishing, content control and VPN practices
CHANGE OF PRIVACY POLICY
A Smartspace reserves the right to update this Privacy Policy as necessary and in accordance with legal requirements. It is up to the User to check whether or not there have been any changes to the Privacy Policy whenever theyaccessing the platform. To this end, we will always include the date of a new version so that you know when a change has been made, as well as providing notices on our website about such an update.

This Privacy Policy is governed by the laws of the Federative Republic of Brazil. Users of this platform submit to the jurisdiction of the District Court of the city of João Pessoa-PB, to the exclusion of any other, however privileged.
